Terms & Conditions

These Terms & Conditions govern your access and use of the www.perhoos.com website (the “Website”) operated by HK XINDA CALCULATE TECHNOLOGY CO., LIMITED (“we”, “us”, “our”). By accessing or using the Website, you agree to be bound by these terms. If you do not agree, do not use the Website.

1. General Provisions

We permit temporary access to the Website and reserve the right to withdraw, amend or restrict access to any part of the Website without prior notice. We will use reasonable efforts to maintain the availability of the Website, but we do not guarantee uninterrupted access. We shall not be liable for any temporary unavailability caused by circumstances beyond our reasonable control, including but not limited to force majeure, maintenance, or third-party service failures. The Terms shall be governed by the laws of Hong Kong Special Administrative Region of the People's Republic of China without regard to its conflict of law provisions and the parties to the Terms agree to submit to the exclusive jurisdiction of the courts of China, Hong Kong.

2. User Obligations

You agree to comply with all applicable laws (including HK law) when using the Website. You shall not misuse the Website, including but not limited to: transmitting malicious, offensive or harmful materials; committing or encouraging criminal offences; hacking or disrupting the Website’s functionality; sending spam; or infringing others’ rights. Misuse may constitute a criminal offence, and we will report such cases to the authorities.

You may only use the Website for browsing products, obtaining information and availing of our services. You may not use the Website for unauthorized commercial purposes. You shall not copy, download, reproduce or exploit any part of the Website without our prior written permission.

3. Member Accounts

Some services require registration, and each user may only have one member account. You are solely responsible for maintaining the confidentiality of your account and password, and for all activities under your account. We reserve the right to terminate or suspend your account if you breach these terms or share your account with others.

4. Transactions

All products displayed on the Website (including but not limited to storage boxes, baskets, laundry hampers, storage racks, shelves, kitchen organizers, bathroom storage supplies, and other household storage essentials) are offered for sale directly by HK XINDA CALCULATE TECHNOLOGY CO., LIMITED ("we", "us", "our"). When you place an order through the Website, you are entering into a direct sales contract with us, not with any third party seller.

All orders are subject to product availability and price confirmation. We reserve the right to refuse or cancel any order for legitimate reasons, including but not limited to: the product being out of stock, payment irregularities, or suspicion of fraudulent activity.

We strive to ensure that all product information (including price, description, and inventory) displayed on the Website is accurate. However, human errors or system errors may occur. If we discover a material error in the price or description of a product you have ordered, we will notify you as soon as possible and give you the option to reconfirm the order at the correct price or cancel it. If we are unable to contact you, or if you choose to cancel due to a pricing error, a full refund will be issued to your original payment method.

Once your order is accepted by us (as evidenced by our order confirmation email sent to you), a binding sales contract is formed between you and us, subject to these Terms & Conditions, our Delivery Information, and our Return & Refund Policy.

5. Limitation of Liability

5.1 Nothing in these Terms & Conditions shall exclude or restrict our liability to you:

(a) for death or personal injury resulting from our negligence (or the negligence of our employees, agents or subcontractors);

(b) for fraud or fraudulent misrepresentation committed by us;

(c) for breach of any statutory implied terms as to title, quiet possession or freedom from encumbrance under the Sale of Goods Ordinance (Cap. 26 of the laws of Hong Kong);

(d) for any other liability which cannot be excluded or limited by applicable law (including but not limited to the Control of Exemption Clauses Ordinance, Cap. 71).

5.2 The Website is provided on an "as is" and "as available" basis. To the maximum extent permitted by the Control of Exemption Clauses Ordinance (Cap. 71) and subject to clause 5.1 above, we exclude all implied warranties, conditions or other terms that may otherwise be implied by statute or common law (including but not limited to any implied warranties of merchantability, satisfactory quality or fitness for a particular purpose) to the extent such exclusion is fair and reasonable having regard to the circumstances which were, or ought reasonably to have been, known to or in the contemplation of the parties at the time these Terms were agreed.

5.3 Subject to clauses 5.1 and 5.2 above, we shall not be liable to you for any direct, indirect, incidental or consequential loss or damage (including without limitation loss of profits, loss of business, loss of revenue, loss of goodwill or loss of data) arising out of or in connection with your use of the Website or any transaction conducted through it, provided that such limitation is fair and reasonable under the Control of Exemption Clauses Ordinance (Cap. 71) having regard to all relevant circumstances, including:

(a) the strength of the bargaining positions of the parties relative to each other;

(b) whether you received an inducement to agree to this limitation;

(c) whether you knew or ought reasonably to have known of the existence and extent of this limitation when you agreed to these Terms;


(d) where the limitation excludes or restricts any relevant liability if some condition is not complied with, whether it was reasonable at the time of entering into these Terms to expect that compliance with that condition would be practicable.

5.4 Where we supply goods in the course of a business, the statutory rights of consumers (including but not limited to the right to claim damages for breach of contract and the right to reject defective goods under the Sale of Goods Ordinance, Cap. 26) are not affected by this clause.

6. Termination

We may terminate your access to the Website immediately for any breach of these terms. You may terminate these terms by giving seven days’ written notice via our customer service email.

7.Intellectual Property

All content on the Website (including but not limited to text, graphics, logos, images, product descriptions, software, and trademarks) is the property of HK XINDA CALCULATE TECHNOLOGY CO., LIMITED or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, display, or create derivative works of any content without our prior written permission.
